Acceptance

By accessing or using the Site, you agree to these Terms and to our Privacy Policy, Cookie Policy and, where relevant, our Donations, Refunds & Recurring Gifts Policy, Volunteer & Ambassador Policy, Safeguarding Policy. If you use the Site on behalf of an organization, you confirm you are authorised to accept these Terms for it.

Permitted use

You may view, download and print pages for your own non-commercial use. You must keep all copyright and proprietary notices. You may not scrape, harvest, republish, sell, license, or use the Site or its content for commercial purposes without our written permission. You may not interfere with the Site, attempt to gain unauthorised access, introduce malicious code, or use the Site in a way that breaks the law or harms others.

Downloading and printing

You may download, display or print information from the Site solely for your non-commercial personal use. You must retain and reproduce every copyright and proprietary notice contained in the information you download. You may not distribute, modify, transmit, reuse, repost or use the content — including text, images, graphics, audio and video — for public or commercial purposes without our written permission. You should assume that everything you see or read on the Site is copyrighted unless otherwise noted.

Trade marks and proprietary rights

The Site may contain or reference trademarks, patents, proprietary information, technologies, products, processes or other proprietary rights of Sneha Karma Foundation and other parties. No license or right in any such trademark, patent, trade secret, technology, product, process or other proprietary right is granted to you. We neither warrant nor represent that your use of materials displayed on the Site will not infringe rights of third parties. Apart from the limited permission above, no license or right in any copyright is granted or conferred to you.

Accounts and donor portal

Some features, including the donor portal, require an account. You agree to provide accurate information, keep your credentials secure, and tell us promptly if you suspect unauthorised access. You may sign in with Google; your use of Google is also governed by Google’s terms. We may suspend or close an account that breaches these Terms, poses a security risk, or is required to be closed by law.

Intellectual property

The Site and its content, including text, images, graphics, logos, audio and video, are owned by or licensed to Sneha Karma Foundation and are protected by copyright and other laws. Except for the limited permission above, no license or right is granted to you. “Sneha Karma Foundation”, the SKF name and logo, and our program names are our marks and may not be used without written permission.

User submissions

If you send us or post content, including messages, photographs, videos, stories or fundraising-page material, you confirm that you own it or have all necessary permissions, including consent from any person shown. You grant us a worldwide, royalty-free license to use, edit, reproduce and publish that content to promote our charitable work, and you waive any right to approve how it is used. You agree to indemnify us against claims arising from content you provide. Media involving beneficiaries is also governed by our Safeguarding Policy.

Submission license and release

For good and valuable consideration, you authorize us to use the written content, images, video and other materials you submit, together with your name, voice, likeness and appearance, and the identifying information you provide (your “Submission”), as follows:

1. Right to use. You grant us the right to edit your Submission and to use and license others to use it, in whole or in part, in all media now known or later invented, in any manner, an unlimited number of times, in perpetuity, worldwide, with or without charge, including for promotion, publicity and marketing of Sneha Karma Foundation.
2. Clearance. You represent and warrant that the Submission is your original work and that you have secured all rights, releases and permissions needed for our use, including for any people, places, music, performances, video, photographs or graphics in it. No further permissions or fees are due. You confirm the statements in the Submission are true to the best of your knowledge and that neither the Submission nor any element of it violates any law or infringes any third-party right.
3. Waiver of approval. You waive any right to inspect or approve the Submission as we use it, including your appearance and the use of your name, and the uses to which they are put.
4. Release and indemnity. You acknowledge that we will rely on this release, potentially at substantial cost, and you waive any claim against any party relating to the exercise of the rights granted. You agree to indemnify, defend and hold us harmless from claims arising from our use of the Submission as permitted here.

Monitoring and enforcement

We may monitor or review postings, transmissions, bulletin boards and similar features, but we are under no obligation to do so and assume no responsibility or liability for their content, including any error, defamation, libel, slander, omission, falsehood, obscenity, profanity, danger or inaccuracy. You agree that violating the acceptable-conduct rules may result in immediate disqualification from participation and may lead to further legal action. We will cooperate with law enforcement authorities or court orders requesting the identity of anyone posting such material.

Acceptable conduct

When using the Site, our community spaces or any interactive feature, you agree not to:

1. post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or discriminatory;
2. harm minors in any way;
3. impersonate any person or organization or misrepresent your affiliation;
4. disguise the origin of any content or manipulate identifiers;
5. post content you do not have the right to share, including confidential information;
6. infringe any copyright, trade mark or other proprietary right;
7. post unsolicited advertising, spam, chain letters or pyramid schemes;
8. introduce viruses or code designed to disrupt or damage systems;
9. interfere with the Site, its servers or connected networks;
10. stalk or harass any person; or
11. collect or store personal data about other users.

We may remove content and suspend access for breaches, and we will cooperate with law enforcement where required.

Donations and refunds

Donations are voluntary gifts, not purchases of goods or services. Payment processing, recurring-gift authorisation, refunds, chargebacks and tax receipts are governed by our Donations, Refunds & Recurring Gifts Policy, which forms part of these Terms.

Volunteering and fundraising

Volunteer and ambassador participation is governed by our Volunteer & Ambassador Policy and our safeguarding rules. Fundraising pages must comply with the fundraising rules in that policy.

Third-party links and services

The Site links to websites and services we do not control, including payment providers, maps, social media and partner sites. We are not responsible for their content, terms or privacy practices. Your use of a third-party service is at your own risk and subject to that provider’s terms.

Disclaimers

We work to keep the Site accurate and available, but the Site and its content are provided “as is” and “as available”. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that the content is complete, current or suitable for your purpose. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Accuracy and availability

We use reasonable efforts to include accurate and up-to-date information, but the Site is provided “as is”. We make no warranties or representations about the content and accept no responsibility or liability arising from or connected with your use of the Site or its content, including its accuracy, completeness, adequacy, timeliness or comprehensiveness. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this may not apply to you. We are not liable for damage to, or viruses that may infect, your equipment or property arising from your access to, use of or browsing of the Site or your downloading of materials. We reserve the right to interrupt or discontinue any or all functionality of the Site and accept no responsibility for any interruption or discontinuance, whether caused by us or a third party. The Site may contain technical inaccuracies or typographical errors, and we may change, correct or improve the information and the products and programs described at any time without notice.

Limitation of liability

To the maximum extent permitted by law, Sneha Karma Foundation and its directors, officers, employees and volunteers are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill or opportunity, arising from your use of the Site or reliance on its content. Where liability cannot be excluded, our total liability is limited to the greater of the amount you donated to us in the 12 months before the claim or USD 100. Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot lawfully be limited.

Governing law and jurisdiction

For users in the United States and elsewhere (other than India), these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and the state and federal courts located in Alameda County, California have exclusive jurisdiction. For users in India, these Terms are also subject to applicable Indian law, and the courts at Mumbai, Maharashtra have jurisdiction over disputes arising from the activities of the India entity. Nothing in this section deprives you of mandatory consumer protections in your country of residence.

Entire agreement and general

These Terms, together with the policies they link to, are the entire agreement between you and Sneha Karma Foundation regarding use of the Site and supersede any other agreement. If any provision is found unenforceable, the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a reorganization or transfer of our charitable activities.
